Last updated: 26 September 2026

1. About us
Elskahouse.com is operated by Modern Labs, trading as Elska House ("we", "us", "our"). We are registered with the Netherlands Chamber of Commerce under number 92161545, with our business address at Drenthehof 149, 5709CL, Helmond, The Netherlands. Our Dutch VAT number is NL003819540B43. You can contact us at info@elskahouse.com.

2. These terms
These terms apply to your use of our website and to every order you place with us. By using our website or placing an order, you agree to these terms. Please read them carefully. These terms are intended for consumers purchasing for personal use.

3. Your account
If you create an account, you are responsible for keeping your login details secure and for all activity on your account. The information you provide must be accurate and up to date. Please tell us immediately if you believe your account has been used without your permission.

4. Products
We describe and display our products as accurately as possible. Small differences in colour may occur because of screen settings, and sizes may vary slightly. All products are subject to availability. We may limit the quantity of a product that can be ordered per customer.

5. Prices
Prices are shown in pounds sterling (GBP) and include UK VAT. Delivery is free. If we have made an obvious pricing error, we will contact you before your order is dispatched. You can then choose to continue at the correct price or cancel for a full refund. Promotions may be subject to their own conditions, which we will show with the promotion.

6. Placing an order
After you place an order, you will receive an email confirming that we have received it. The contract between you and us is formed when we send you this order confirmation. We may refuse or cancel an order, for example if a product is unavailable, if there is a pricing error or if we suspect fraud. In that case, we will inform you and refund any payment in full.

7. Payment
Payment is made at checkout through the payment methods shown in our store. Payments are processed securely by our payment providers. You confirm that you are authorised to use the payment method you provide.

8. Delivery
Delivery details are set out in our Shipping Policy. Ownership of and risk in the products pass to you on delivery.

9. Your right to cancel and return
You have the right to cancel your order and return products as described in our Refund Policy. We offer a 30-day return period, which is longer than the 14 days required by law.

10. Your statutory rights
We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. Nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015. For advice about your rights, contact Citizens Advice (citizensadvice.org.uk).

11. Use of our website
You may use our website for lawful, personal purposes only. You must not:

  • use the website for any unlawful, fraudulent or harmful purpose;
  • harass, abuse or threaten our staff or other people;
  • upload or transmit viruses or other malicious code;
  • attempt to gain unauthorised access to the website, our systems or other users' data;
  • copy, scrape, resell or commercially exploit any part of the website;
  • send spam or unsolicited advertising through the website;
  • impersonate any other person or provide false information.

12. Automated access and AI agents
You must not use robots, scrapers or other automated tools to access or collect data from our website without our written permission. If you use an AI agent or other automated software to browse or shop on our website on your behalf, it must clearly identify itself as automated software. It must not bypass CAPTCHAs, security measures or any restrictions we place on automated access. You remain responsible for any order placed by software acting on your behalf. We may limit or block automated access to protect our website and customers.

13. Reviews and feedback
If you submit a review, suggestion or other content to us, you give us a non-exclusive, worldwide, royalty-free licence to use, display and publish it in connection with our store and our marketing. We may shorten your content for display, but we will not change its meaning. Your content must be honest, must reflect your own experience, and must not be unlawful, offensive or infringe anyone else's rights. We may remove content that breaks these rules. We do not remove or hide reviews because they are negative, and we do not publish fake reviews.

14. Intellectual property
All content on our website, including text, images, logos and design, is owned by us or our licensors and is protected by intellectual property law. You may view and print content for your personal use only. You may not copy, reproduce, distribute or use it for commercial purposes without our prior written permission.

15. Third-party links and tools
Our website may contain links to, or tools provided by, third parties. We do not control these and are not responsible for their content, products or practices. Your use of third-party websites and tools is subject to their own terms and privacy policies.

16. Our relationship with Shopify
Our store is powered by Shopify. Any purchase you make on our website is a contract between you and us, not between you and Shopify. Shopify is not a party to that contract and is not responsible for the sale. This does not affect any of your rights against us.

17. Our liability
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable. We supply products for domestic and private use only, and we are not liable for any business losses.

We do not exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your legal rights in relation to the products;
  • any other liability that cannot be excluded or limited by law.

18. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control. If such an event occurs, we will inform you and take steps to minimise the delay. If there is a risk of substantial delay, you may cancel your order and receive a full refund.

19. Suspension of access
We may suspend or close your account, or restrict your access to our website, if you seriously or repeatedly breach these terms. This does not affect any order already placed or your statutory rights in relation to it.

20. Personal data
We process your personal data as described in our Privacy Policy.

21. Complaints
If you have a complaint, please contact us at info@elskahouse.com. We aim to respond within 2 business days and to resolve your complaint as quickly as possible. We are not obliged to use, and do not currently use, an alternative dispute resolution (ADR) provider.

22. Governing law and jurisdiction
These terms are governed by Dutch law. However, as a consumer resident in the United Kingdom, you keep the protection of the mandatory consumer laws of the part of the UK where you live. You may bring legal proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.

23. Other important terms
If a court finds any part of these terms invalid, the remaining parts will continue to apply. If we do not enforce a right straight away, we can still enforce it later. We may transfer our rights and obligations under these terms to another organisation, but this will not affect your rights. You may only transfer your rights to another person with our written consent.

24. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the version published on our website at the time you placed it. Changes do not affect orders already placed.
